Personal Injury Lawyers in Huntsville
Huntsville is a city on the rise. With a population that’s growing year over year and new businesses popping up almost every day, Huntsville, AL is one of the most exciting places to live in Alabama right now.
With all the hustle and bustle, it’s no wonder that personal injury cases are still a major problem within the community. With so many Huntsville personal injury lawyers vying for your attention, you’ll need to choose carefully who will represent your personal injury cases.
Do I Have the Basis for a Personal Injury Case?
The specifics of different cases may change the requirements, but generally, you will have a personal injury case according to Alabama law if you can establish the following.
Duty of Care
To argue that you were harmed at no fault of your own, you must first prove that someone else owed you a legal duty of care. At any given time, you may owe others around you a duty of care. For instance, when driving, you owe a duty of care to other drivers on the road by driving safely and following the law. However, you do not always owe others a duty of care, as in the case of witnessing a slip and fall accident on a property that is not yours.
Breach of Duty of Care
Once you’ve established that the person you’re bringing the case against had a duty of care, you must show how they broke the expectation of care. Take, for example, cases involving defective products. If the product was medicine but was poorly made, resulting in sickness, the breach of duty of care was the failure to provide the product that was promised.
While someone else may have breached their duty of care, their negligence may not be relevant if it didn’t cause the injury. So, we have to prove causation. Once again using the products liability example, the negligence of putting the wrong ingredients in the product directly caused the injury to occur. Without the link of causation, even if someone else was being negligent or acting wrongfully, you do not have a personal injury case.
Even if someone else’s actions caused the event to happen, you must prove that you experienced damages as a result. In the case of a car accident, if the person breached a duty of care by texting and driving, causing you to swerve off the road, if you and your vehicle are unscathed, you do not have any damages to claim.
Similarly, if the damages happening around this same event did not occur as a result of the breach of care, you do not have a case. To illustrate, if you had a car accident where you were not at fault but had no other damages other than breaking your arm while getting out of your car, no damages occurred as a result, making your claim null and void.
